This cottage is located on Lake Orion with a spectacular view of the water. If you enjoy relaxing on your own sandy beach, paddle boarding, paddle boating, kayaking, and swimming, then this is the perfect cottage for you! Enjoy breathtaking sunsets from the back patio or fishing off your dock. Whether it's relaxing or playing, this is the place where memories are made and the adventure begins! Long- term Rental/license agreement needs to be signed by guest. (6 person Maximum Occupancy)

Boendet
Let the adventure begin! Make sure to bring your swim suit, sunscreen and flip flops. Beach towels are provided for outside use and life vests are provided for your safety. If you have younger children, you may want to bring a life vest that is specific to their size. If you love to fish, bring your fishing tackle. There is monster Bass in this lake. Outside loungers, chairs/table and a 4 person swing is located on the beach area. Parking is available off of premises, however a golf cart will be provided for guest to drive to and from grounds as this is all part of the adventure. Kitchen has a refrigerator/w ice maker and water. It also has coffee maker, microwave, toaster, range, dishes, silverware, utensils and pots/pan. Some basic condiments will also be available such as salt, pepper, garlic, sugar, coffee and oil.. Also, a BBQ grill is located outside for your use. BBQ area also has a food prep table, small refrigerator and sink. Extra blankets, and pillows are available upon guests request. Hangers are in closets for guests to use. Pack-n-Play with sheets is also available for guest use. Upstairs and downstairs bathrooms have a tub/shower and shampoo and soap will be provided. If guest forgets any toiletries such as toothbrush, toothpaste or razors, I will do my best to accommodate for your needs. There is also a television in upstairs living room and downstairs living area. If you have children, cleaning products will be kept on high shelf of linen closet upstairs and clothes detergent/cleaners will be kept on high shelf by washer and dryer space downstairs.

PERSONAL PROPERTY LICENSE AGREEMENT
This License Agreement is made and entered into this __day of_____________ , 2020, between Lake Orion Rental, LLC, and ________________________(hereinafter called "Licensee").
WITNESSETH:
Subject to and upon the terms, provisions, covenants and conditions hereinafter set forth, LAKE ORION RENTAL, LLC does hereby grant to Licensee the right and license to use certain personal items and properties located on the premises located at 599 Westpointe Court, Lake Orion, MI 48362 and to be designated for Licensee's use, which includes, but is not limited to, the personal properties attached to Schedule A hereto, which is incorporated by reference in this Agreement (hereinafter, the “Personal Properties”).
1. TERM
The term of the License hereby granted shall be the same length of the term reflected in the Long Terms Rental Agreement entered into by the parties, the terms of which are incorporated herein by reference. Either party hereto may terminate the License granted hereby by giving written notice of termination as hereinafter provided, and the License hereby granted shall terminate upon the date so stated.
2. FEE
As consideration for the License hereby granted, Licensee agrees to pay to LAKE ORION RENTAL, LLC, the Rental Amount reflected in the Long Term Rental Agreement which provides the right to use the Personal Properties, plus the additional sum of $1.00.
3. REPAIRS
Licensee will not commit waste upon or injure the Personal Properties but will maintain them and the equipment it contains in a clean and attractive condition. Upon termination of this License Agreement, Licensee shall surrender and deliver up the Personal Properties and equipment attached thereto to LAKE ORION RENTAL, LLC in the same condition in which it existed at the commencement of this License Agreement, excepting ordinary wear and tear, damage arising from acts of God and damage required thereunder to be repaired by LAKE ORION RENTAL, LLC. LAKE ORION RENTAL, LLC shall have the right, but not the obligation, to enter upon any part of the Personal Properties at all reasonable hours to inspect same and to make repairs thereto, and in connection with the making of repairs, to temporarily relocate any Personal Properties. If LAKE ORION RENTAL, LLC considers necessary any maintenance, cleaning or repairs required by the provisions of this License Agreement to be made by Licensee due to damage caused by Licensee’s gross negligence or intentionally, LAKE ORION RENTAL, LLC may request Licensee to make such repairs or maintenance or perform such cleaning and upon Licensee's failure or refusal to do so within ten (10) days LAKE ORION RENTAL, LLC shall have the right (but no obligation) to perform such maintenance or make such repairs whereupon Licensee shall, upon demand by LAKE ORION RENTAL, LLC, be responsible to reimburse LAKE ORION RENTAL, LLC for the cost of such repairs. Licensee acknowledges that certain of the Personal Properties may not be available during the time of Licensee’s occupancy of the Premises due to maintenance or repairs and Licensee shall not be entitled to reimbursement of any fees.
4. SUBLETTING AND ASSIGNMENT
The License hereby granted may not be conveyed, sublet or assigned without prior written consent of LAKE ORION RENTAL, LLC and any propertied conveyance, sub-letting or assignment in violation of the terms hereof shall be void and of no force or effect.
5. USE
Licensee will use the Personal Properties solely for the purpose of which each respective Personal Property is naturally intended and will not use or permit use of the Personal Properties for any other purpose without the prior written consent of LAKE ORION RENTAL, LLC. Licensee will comply with all Federal, State, Municipal and other laws, ordinances, and regulations applicable to the use of the Personal Properties by Licensee. Licensee shall maintain the cleanliness of all Personal Properties, including removal of trash, garbage and other waste. Licensee will not make any unlawful use of the Personal Properties or permit any unlawful use thereof. Licensee will not commit any act which is a nuisance or annoyance to LAKE ORION RENTAL, LLC, other residents of Lake Orion, or which might appreciably do damage to the good will of the Premises.
6. RELEASE FROM LIABILITY
A. GENERAL INDEMNITY, RELEASE AND INSURANCE.
THE FOLLOWING SECTIONS 6.B THROUGH 6.E SET FORTH AND GOVERN THE RIGHTS, AGREEMENTS, AND OBLIGATIONS OF THE PARTIES PERTAINING TO: (1) INDEMNIFICATION AND HOLD HARMLESS PROVISIONS INCLUDING PROVISIONS WHEREBY ONE PARTY MAY BE REQUIRED TO INDEMNIFY, DEFEND AND HOLD HARMLESS THE OTHER PARTY FOR CLAIMS ARISING FROM SUCH OTHER PARTY’S NEGLIGENCE OR STRICT LIABILITY; (2) RELEASE OF CLAIMS AND LIABILITY PROVISIONS; AND (3) INSURANCE REQUIREMENTS.
B. Definitions, For the purpose of this Section, the following definitions and general provisions shall apply.
The term “LAKE ORION RENTAL, LLC” shall mean LAKE ORION RENTAL, LLC, its parent, subsidiaries, affiliated companies, co-owners, members, attorneys and each of their respective insurers, consultants, officers, directors and employees, and the term “Licensee” shall mean the Licensee, their family members, invitees, contractors and subcontractors of every tier and each of their respective insurers. In the event LAKE ORION RENTAL, LLC must bring legal action in order to enforce an indemnification, all reasonable costs and expenses related to that action shall be included as part of the indemnification. If a claim is asserted against one of the parties to this Agreement that may give rise to a claim for indemnity against the other party hereto, the party against whom the claim is first asserted shall immediately notify the potential indemnitor in writing and give the potential indemnitor the right to defend the defense of the claim. Notwithstanding anything stated in the Agreement to the contrary, all release and indemnity provisions hereof shall survive the termination or expiration of this Agreement, without limit in time, except time limits imposed by the applicable statues of limitations or prescriptive periods. For this purpose of this Agreement, the term “Gross Negligence” shall be defined to mean such lack of care by a party or a person as to indicate a conscious indifference and reckless disregard for the safety of people and property. For the purpose of this Agreement, the phrase “Regardless of Fault” shall mean without regard to the cause(s) thereof including, without limitation, preexisting conditions, imperfection of material, defect or failure of equipment, ultra hazardous activity, strict liability, breach of statutory duty, breach of safety requirement or the negligence of any party or parties, whether such negligence be sole, joint, contributory, or concurrent, active or passive, but expressly not including Gross Negligence or willful misconduct.
C. LICENSEE’S INDEMNITY OBLIGATION.
LICENSEE AGREES TO DEFEND, INDEMNIFY, AND HOLD LAKE ORION RENTAL, LLC HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, CLAIMS, DEMANDS, FINES, PENALTIES, LIABILITIES, OR CAUSES OF ACTION OF EVERY KIND AND CHARACTER, INCLUDING COSTS OF LITIGATION, ATTORNEYS’ FEES AND REASONABLE EXPENSES IN CONNECTION THEREWITH, ON ACCOUNT OF BODILY INJURY TO, ILLNESS OR DEATH OF ANY FAMILY MEMBER, INVITEE, LICENSEE, EMPLOYEE, AGENT OR REPRESENTATIVE OF LICENSEE, AND FOR DAMAGE TO PROPERTY (WHETHER REAL OR PERSONAL, OWNED OR LEASED) OF LICENSEE THAT ARISES OUT OF, IN CONNECTION WITH, INCIDENT TO OR RESULT DIRECTLY OR INDIRECTLY FROM THE USE OF ANY PERSONAL PROPERTIES AND REGARDLESS OF FAULT. THE FOREGOING DEFENSE, INDEMNITY AND HOLD HARMLESS OBLIGATIONS OF LICENSEE SHALL NOT APPLY TO THE EXTENT THAT SUCH BODILY INJURIES, ILLNESS, DEATHS OR DAMAGE TO PROPERTY ARE CAUSED BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF ANY MEMBER OF LAKE ORION RENTAL, LLC.
D. LICENSEE OBLIGATION
LICENSEE SHALL RELEASE, INDEMNIFY, DEFEND, AND HOLD LAKE ORION RENTAL, LLC HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, CLAIMS, DEMANDS, FINES, PENALTIES, LIABILITIES OR CAUSES OF ACTION OF EVERY KIND AND CHARACTER, INCLUDING COSTS OF LITIGATION, ATTORNEYS’ FEES, AND REASONABLE EXPENSES IN CONNECTION THEREWITH, OF ANY THIRD PARTY PERSON OR THIRD PARTY ENTITY FOR, RESULTING FROM OR ON ACCOUNT OF (i) PERSONAL INJURY TO, ILLNESS OR DEATH OF ANY THIRD PARTY OR (ii) DAMAGE TO PROPERTY OF ANY THIRD PARTY.
E. Insurance Generally.
Licensee expressly recognizes that any insurance for loss which the Lake Orion Renal, LLC may maintain with respect to the Personal Properties does not cover the personal property of Licensee, and that Licensee should purchase their own insurance if such coverage is desired.
7. DEFAULT AND REMEDIES
In the event of the failure or refusal of Licensee to pay in a timely manner the rental or other monetary charges due to be paid to LAKE ORION RENTAL, LLC when due or in the event of Licensee's failure to perform or observe any other covenant or condition of this License Agreement, the License herein granted and the benefits hereof to Licensee shall, at the option of LAKE ORION RENTAL, LLC, immediately terminate without further notice of such termination. LAKE ORION RENTAL, LLC may enter upon and take possession of the Personal Properties. All claims by Licensee against LAKE ORION RENTAL, LLC for damages by reason of any such removal of the Personal Properties are hereby waived. In the event of termination of the License hereby granted notwithstanding such termination, Licensee shall be liable for and shall pay to LAKE ORION RENTAL, LLC at the same place provided for the payment of the Personal Properties fee, the sum of all Personal Properties fees and other indebtedness accrued to the date of such termination. The remedies set out above shall be cumulative and shall be in addition to LAKE ORION RENTAL, LLC's remedies at law, and Licensee will pay LAKE ORION RENTAL, LLC's expenses incurred in the enforcing of such remedies for any default of Licensee, including reasonable attorney's fees.

LONG TERM RENTAL AGREEMENT

1. The Parties
This agreement is made this ____ day of _____________________________, 2020 between _______________________ of __________________________________________ (hereinafter referred to as “Guest” or “Guests”), and Lake Orion Rental, LLC (hereinafter referred to as “Host”).
2. The Property
Property Location: 599/1 Westpointe Court, Lake Orion, MI 48362 (hereinafter referred to as the “Premises”)
3. Period and Guests
Total people in renting party may not exceed 6 people, including children.
Rental period begins at 3:00 PM on the ____ day of _____________________________, 2020 and ends at 11:00 AM on the day of _____________________________, 2020.
4. Rental Amount
Total rental amount for the period is ____________________ Dollars ($____________) (hereinafter, the “Rental Amount”) or equal to ____________________ Dollars ($____________) per night. The terms of payments and all refunds are pursuant to the Cancellation Policies (STRICT) of Airbnb, which are attached as Schedule A hereto, and incorporated by reference. By entering into this Agreement, Guest acknowledges receipt and review of Schedule A. Payment of the Rental Amount shall be made through Airbnb.
The Rental Amount is exclusive of any other fees charged by Airbnb.
5. Security Deposit and Cleaning Fee
In addition to the rental amount reflected above, Guest shall be responsible for a Security Deposit in the amount of $5000. Pursuant to Airbnb policy regarding Security Deposits, Guest is not required to pay this sum upon making a reservation. Instead, Guest shall be charged up to the full amount in the event Host makes a claim on the Security Deposit. All security deposits are paid through Airbnb. Host can request some or all of the security deposit within 14 days of when the Guest checks out or before a new Guest checks in, whichever is first.
In addition, Guest shall pay a cleaning fee of $100.00 through Airbnb. Refund of this fee is subject to the terms of the Cancellation Policies (STRICT) of Airbnb.
6. Termination

The Host shall have unlimited access to the Premises during the Guests’ stay. Should the Guest violate any of the terms of this agreement, the rental period shall be terminated immediately, all Guests shall be immediately removed from the Premises, and the full Rental Amount and Cleaning Fee shall be forfeited. The Guests waive all rights to process if they fail to vacate the Premises immediately upon termination of the rental period. The Guests shall vacate the premises at the expiration time and date of this agreement.
7. Effective Date
This Agreement is effective upon the later of the parties executing the Agreement and Guest submitting payment in full through Airbnb.
8. Maintenance and Repairs
The Guests shall maintain the Premises in a good, clean, and ready to rent condition, and use the Premises only in a careful and lawful manner. The Guests shall leave the Premises in a ready to rent condition at the expiration of the rental agreement, defined by the Host as being immediately habitable by the next Guests. Guests shall pay for maintenance and repairs should the premises be left in a lesser condition. The Guests agree that the Host shall deduct costs of said services from the security deposit prior to refund if Guests cause damage to the premises or its furnishings.
9. Trash
The Guests shall dispose of all waste material generated during the rental period in the trash cans located on the Premises.
10. Pets are not permitted.

11. Subletting
The Guest shall not have the right to sublet the property.

12. Quiet Enjoyment
The Guests shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Guests shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Guests shall then immediately vacate the premises.
13. Smoking
Smoking is not allowed inside the home.
14. Personal Items
Host shall provide the following to the Guest:

(all items in this section are hereafter referred to as “Personal Items”)
Towels, linens, silverware, and dishes.
15. Host’s Liability
The Guests and Guests' Guests shall hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss whatsoever arising from use of the Premises or any of the Personal Items therein, regardless of the nature of the accident, injury or loss. Guests expressly recognize that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guests, and that Guests should purchase their own insurance for Guests and Guests if such coverage is desired.
16.. Attorney’s Fees
Guests agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Host enforcing this agreement.
17. Use of Property
Guests expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guests do not intend to make the property a residence or household.
18. Shortened Stays and Conditions
Refunds of payment due to shortened stays or ruined expectations because of weather conditions shall be subject to the terms of the Cancellation Policies (STRICT) of Airbnb.
19. Firearms
Only legally owned and permitted firearms shall be allowed on the Premises according to State and local laws.
20. Fireworks
Guest agrees that Fireworks and other hazardous materials shall not be used in or around the property.
21. Illegal Use
Guest shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits.
22. Fire Alarms
If the Premises has fire alarms the Guest must notify the Host without delay if a fire alarm “chirps” or has a low battery condition.
23. Possessions
Valuable items left behind by Guest will be held for the Guest and every reasonable effort will be made to contact the Guest for return. If items are not claimed for longer than 6 months they shall become the property of the Host. The Host shall not be held liable for condition of said items.

26. Governing Law

27. Creation of License Agreement
All parties agree that this Agreement creates a temporary license agreement. By entering into this Agreement, the parties do not intend to create a tenancy agreement, no tenancy relationship is created, and the Guests are not afforded the rights of tenants under applicable law.
28. Other Agreements
